#UGANDA: HIGH COURT STRIKES OUT 97 AFFIDAVITS IN NUP PETITION ON KAMPALA CENTRAL ELECTION
The High Court in Kampala has struck out 97 affidavits filed by National Unity Platform (NUP) Secretary General David Lewis Rubongoya, delivering a major setback to his petition challenging the election of Kampala Central MP Minsa Kabanda Nabbengo.
Justice Flavia Nabakooza Kalungi ruled that the affidavits, submitted months after the petition was lodged, were irregularly introduced without leave of court and therefore expunged from the record.
Rubongoya’s petition had alleged altered results forms, voter intimidation, ballot stuffing, and questions over Kabanda’s eligibility, but the removal of the affidavits significantly weakens his case.
Kabanda, who was declared winner with 22,280 votes against Rubongoya’s 18,211, has maintained her victory was legitimate.
The Electoral Commission also defended the results, arguing the late affidavits were an attempt to introduce fresh evidence outside the legal timeframe.
