Arlington’s Commonwealth’s Attorney testified that her office has a DUI policy specifically for DACA recipients. In a small number of cases, prosecutors have considered changing a DUI to a different first-degree misdemeanor so the defendant can renew DACA status. (We don’t have first-degree misdemeanors - they are called Class 1 misdemeanors - surprised an elected prosecutor doesn’t know that). She says the defendant is still held accountable and the original DUI charge remains visible. But DACA status is a factor in the plea resolution, one that an American citizen charged with the same offense cannot invoke. DOJ concludes Eighteen-to-twenty-year-olds are part of “the people” protected by the Second Amendment and federal bans prohibiting handgun sales can no longer be criminally prosecuted. It is time for an 18 year old to sue Virginia who prohibits concealed handgun permits from being issued to anyone under 21. There is no such thing as a super adult. Any interesting case was filed to the US Supreme Court - Johnson v. Jacobson, U.S. Supreme Court No. 26-255. The question: Whether Americans must obtain a firearm license from each state to exercise their Second Amendment rights across the Nation. States like Minnesota historically do not recognize most concealed carry permits issued by other states. The question is - can Minnesota do this under Bruen. Legal posture: District Court - Lost 8th Circuit Court of Appeals - Lost The US Supreme Court has not accepted this appeal - and it appears unlikely to do so - but the question is interesting. My Virginia drivers license works in Minnesota. Why does my Virginia concealed handgun permit not? I do not think the question is the best it could be - a better question should be - why do we need a permit at all? Simple - States that require permits make it a crime to carry without one. In Virginia 1st offense is a misdemeanor - 2nd offense is a felony. The question should be better asked "Can states criminalize citizens for concealed carrying firearms in public" The legal issues are further complicated, because Virginia reciprocity agreements are likely about to be revoked by 2 Shot Jay Jones on 12/1/26. When Virginia revokes state X - then state X may revoke Virginia. Virginians will likely lose many state reciprocity agreements This is why Virginians are pouring in to get a Utah non-resident permit. Getting a non-resident permit will provide some backstop to Virginia changes until such a day as SCOTUS addresses this issue. I was not going to post anything today in respect of 9/11. But after seeing AOC and the communist Mayor of NYC smoking and joking during the solemn moment of reading the names of the victims - I decided this is an appropriate 9/11 post. They have no respect or love for their city, their state or their country. One is a sitting member of the House and possible presidential nominee the other is the mayor of a city that has more people than most US states. Disgusting. Never forget.

December 1, 2026 is when the Va Attorney General will start revoking concealed carry recognition agreements in Virginia. This is why I have been teaching the Utah class and encouraging everyone to get the permit. I Don’t know for sure which states will be revoked but in 2015 Atty General Mark Herring created this list of states that should be revoked and I have a very good feeling that this Is what Jay Jones is going to follow * Alaska * Arizona * Arkansas * Delaware * Florida * Idaho * Indiana * Kansas * Kentucky * Louisiana * Minnesota * Mississippi * Montana * Nebraska * New Mexico * North Carolina * North Dakota * Ohio * Pennsylvania * South Carolina * South Dakota * Tennessee * Washington * Wisconsin * Wyoming If you obtain a Utah nonresident permit, you will be able to carry in most of these states if your Virginia permit no longer works there. In February 2026, Virginia Beach quietly revised an administrative directive governing political speech on City property. This was not an ordinance passed by City Council but applied by faceless bureaucrats. The directive allows citizens to hold signs in designated areas around City Hall and the courthouse, shown on the attached maps. But at the Voter Registrar’s Office and early-voting locations, it declares “no signs permitted”—including signs carried by a person—anywhere on City property, even outside Virginia’s existing 40-foot no-campaigning zone. The ban lasts throughout early voting, while “government speech” is expressly exempted. In plain English, the City allows itself to speak at voting locations while silencing political candidates and causes at the very place where political speech matters most. That is a clear violation of the First Amendment. Any candidate - regardless of party or cause - who wants to talk about this - is welcome to message me. This “directive” cannot stand unchallenged. Not if the First Amendment means anything.

Four years ago, a man walked into my office and said, “I need help. Child Protective Services took my children.” I told him what I tell everyone: I do not handle custody cases. But he brought me a book of documents the size of a dictionary and asked me to do one thing—just look at it. I did. What I saw was an abuse of the system and a father whose parental rights were being stripped away. So I took the case. We fought—and lost. We appealed—and lost. We appealed to the Supreme Court—and lost. We returned to the Circuit Court—and lost again. Years passed. It was loss after loss after loss. Then the guardian ad litem made a critical mistake. She accused my client of violating multiple court orders. We tried those charges and defeated them. In the process we succeeded in having the GAL removed. Then the dam broke. We got the case transferred to another court. And today, we walked out of that courthouse with full custody restored to a father who lost his son five years ago. This has been one of the most biblical cases of my legal career. It taught me that losing is part of life—but giving up is a choice. We fought. We lost. We fought again. And again. And again. Even when winning seemed completely impossible, we refused to quit. Today, the system finally listened—and a father got his son back. This case changed me. It changed the way I see the law. The law is not always fair. The system is not always fair. But if you keep fighting long enough, the truth has a chance to come out. Never give up.

🚨 Virginia Beach School Board was held in contempt of court yesterday and sanctions were issued. 🚨 Yesterday, the Virginia Beach School Board was found in willful contempt of court and ordered to pay my law firm $6,831.50. Why? In January, after finding that the School Board acted arbitrarily and capriciously in the Kellam case, the judge vacated its decision that three students had racially bullied and harassed one of their closest friends. The court ordered the School Board to ensure the students’ educational records reflected that ruling. For six months, the School Board refused to comply. Even after a July hearing, it merely moved the paper disciplinary files from Kellam High School to a locked cabinet in another office without marking them to show that the disciplinary findings had been vacated. At yesterday’s contempt hearing, the judge said he was “astonished” and found the School Board in willful contempt through August 31. The court ordered that every educational record, wherever located and in whatever form, reflect that the School Board’s decision was vacated. The School Board was given until 5:00 p.m. today to comply. After that deadline, it faces a coercive penalty of $1,000 for every day or portion of a day it remains out of compliance, payable to the Literary Fund. The court also ordered it to pay $6,831.50 in attorney’s fees and costs caused by its refusal to follow the original order. For seven months, the Virginia Beach School Board acted as though it was above the law. The adults entrusted with serving children would rather fight to preserve a decision already declared unlawful than simply admit they were wrong and do the right thing. And who pays for this arrogance? Not the administrators who made the decisions. The taxpayers do. What a joke. I am going to donate the money. I am not trying to take money from schools - but nothing else matters to them - so I will force them to pay to compel compliance. If you are a teacher and need some supplies in your classroom- let me know. Once I get paid it will immediately find good ways to help students learn and make this year a little better.
