Crypto regulation in the United States is entering a more formal phase, and the SEC’s proposed Reg Crypto is a good example of what this looks like. For years, crypto policy has developed through enforcement actions, staff guidance, speeches, and interpretive statements. However, formal rulemaking creates a stronger framework by giving market participants a more tangible opportunity to engage with the substance of a proposal before it becomes final. Reg Crypto addresses areas including token offerings, disclosures, exemptions, and how certain crypto-related activities fit within the SEC’s regulatory framework. For businesses building in this space, clearer rules can provide a better understanding of what they can build, how they can comply, and where regulatory responsibility sits. New comment letter just dropped 📄 The @SECGov's proposed Reg Crypto is an important step toward a tailored framework for crypto offerings. Our submission focuses on one piece that will shape everything that follows: how “crypto asset” is defined. 🧐 Even though things like a concert ticket, a loyalty point, a tokenized security, and a protocol-native token can all be recorded on a blockchain, they carry VERY different rights, functions, and risks. Blockchain can show you that a transaction happened, it can tell you when it happened, and which key signed it. However, the dispute rarely ends there. It looks at the full ecosystem around vaults, including curators, risk managers, custodians, compliance providers, tokenized assets, AI agents, and institutional users. For policymakers, that level of detail is crucial because responsibility depends heavily on function, discretion, governance, and control. This fall, one of our big focuses at the Avalanche Policy Coalition is the SEC’s proposed Reg Crypto. The key issue is (you guessed it) token classification. Not everything represented on a blockchain is a financial product, and definitions that are too broad can create very messy results. We’ll also be watching how the proposal treats existing tokens, “issuers,” and exemptions. Stay tuned for more this fall 🍂
