Steve Baker was not aware of anything leading up to the interrogation because he didn't know Brian Cole was a suspect, or was going to get arrested. He's saying this looking backwards with what he thinks he knows. Since the interview and confession was taped, we're going to see if Cole was "coerced to waive Miranda." The waiver of rights form that Cole signed is written at about the 6th grade level. Baker himself has described Cole, (who, BTW, he has never even met,) as "extremely bright." "With the FBI having full knowledge of his disabilities..." We're told in filings that after he was arrested, (and after the interview,) Cole was diagnosed for the first time, at age ~35, as Autistic Level 1. It's the same diagnosis that Elon Musk claims. Baker has tried to portray Cole during multiple podcast interviews as a "Five minutes to Wapner, Rain Man" character, which seems wildly overblown. FBI agents are trained in a lot of things. Diagnosing Autism Level 1 is not one of them. And even if they could have made a diagnosis, that would not preclude them from conducting a knowing and voluntary interview of an arrested subject with that diagnosis. Autism Level 1 is not a defense to a felony, nor does it preclude an knowing and voluntary confession. Baker is projecting that which he knows nothing about concerning what the government knows and thinks. They don't charge terrorism and WMD crimes hoping for a quick plea deal. And it's rich he'd bring up legal shenanigans since a legal shenanigan we might see a ruling on soon his his attempt to use Brian Cole, Jr.'s defense attorneys as his civil attorneys, for the obvious reasons.
