Important to note that Jack Smith knew he had judges--including Beryl Howell and Jeb Boasberg--in his back pocket. They not only conducted zero oversight of his rogue operation, they quickly issued nondisclosure orders for several subpoenas including Howell's egregious NDO on Smith's demand for the president's Twitter data, which clearly violated Trump's executive privilege rights (as the DC appellate court noted after it was too late.) One way to fix this is to revise the Stored Communications Act to require judges to perform more due diligence before authorizing an NDO. The judge should be required BY LAW to attach any findings of potential obstruction or threats to witnesses if the target is notified of the search--and certainly any evidence of the target representing a flight risk, as Howell did in the Twitter case (only to pull it back before the documents went public.) This--along with impeachment of those judges--can put an end to this in the future. But unfortunately we've seen no action on any front to hold the judges, who are ultimately responsible for conducting oversight of these matters, accountable.
