𝗟𝗮 𝗨𝗘 𝘀𝗲 𝘀𝘂𝗺𝗮 𝗮 𝗹𝗮 𝗼𝗹𝗮 𝗽𝗿𝗼𝘁𝗲𝗰𝗰𝗶𝗼𝗻𝗶𝘀𝘁𝗮 𝗰𝗼𝗻 𝘃𝗮𝗿𝗶𝗮𝘀 𝗻𝗼𝗿𝗺𝗮𝘀 𝗾𝘂𝗲 𝗳𝗮𝘃𝗼𝗿𝗲𝗰𝗲𝗻 𝗮 𝗹𝗮𝘀 𝗲𝗺𝗽𝗿𝗲𝘀𝗮𝘀 𝗲𝘂𝗿𝗼𝗽𝗲𝗮𝘀 𝗳𝗿𝗲𝗻𝘁𝗲 𝗮 𝗹𝗮𝘀 𝗱𝗲 𝘁𝗲𝗿𝗰𝗲𝗿𝗼𝘀 𝗽𝗮𝗶́𝘀𝗲𝘀 Muchas gracias a @manuelvgomez por contar con mi visión y citar mi paper para @CEPS_thinktank en su interesante artículo para @el_pais A continuación, un resumen de algunas ideas que compartí con él y en comentarios, enlace a mi paper de CEPS. ➡️Desde 2022, la UE ha ido condicionando el acceso a los contratos públicos y a la financiación europea vinculada a ellos a criterios de origen, control o producción en la UE. ➡️Este cuerpo normativo no se ha diseñado como un régimen coherente: se ha ido acumulando instrumento a instrumento (IPI, NZIA, SAFE, EDIP, la propuesta de IAA, el Cloud and AI Development Act), sin que nadie se haya preguntado cómo encajan las piezas entre sí. ➡️La UE ha defendido durante décadas que los mercados de contratación pública abiertos son más eficientes. Esos argumentos no pierden fuerza cuando se aplican hacia dentro. Si la UE va a construir una arquitectura de preferencia europea, debería hacerlo respetando los principios que ha exigido a otros: reglas claras, excepciones justificadas, reciprocidad y control judicial efectivo. ➡️ 𝗧𝗿𝗲𝘀 𝗿𝗶𝗲𝘀𝗴𝗼𝘀. 💶 Precios: sobrecostes del 15 al 50% por requisitos de contenido local, en mercados donde las licitaciones con un solo oferente pasaron del 23,5% en 2011 al 41,8% en 2021. ⚖️ Exposición legal: tensión con el Acuerdo de Contratación Pública de la OMC y con los Tratados. 📋 Carga administrativa: inasumible para buena parte de los más de 250.000 poderes adjudicadores de la UE y para las pymes, que ganan el 71% de los contratos por número pero solo el 33% por valor. ➡️𝗠𝗮𝗱𝗲 𝗶𝗻 𝗘𝘂𝗿𝗼𝗽𝗲 𝘃𝘀 𝗠𝗮𝗱𝗲 𝘄𝗶𝘁𝗵 𝗘𝘂𝗿𝗼𝗽𝗲. Las configuraciones que permiten la participación de terceros países sujeta a salvaguardas operativas logran los mismos objetivos de seguridad y resiliencia con menor coste legal, económico y administrativo. La propia práctica europea lo confirma: en la primera licitación bajo el Cloud Sovereignty Framework ningún consorcio alcanzó el nivel máximo de soberanía, y SAFE ha tenido que abrirse a Japón, Corea del Sur y Canadá. ➡️ El riesgo final no es tanto el aislamiento como la incoherencia: un régimen que nadie ha diseñado, que encarece la contratación y que erosiona la credibilidad exterior de la UE como defensora de mercados abiertos. elpais.com/economia/2026-08-…
