Ironically, the GMC admit they know the law is sometimes wrong
Only a few weeks ago they even openly admitted this- offering a full apology to doctors they chose to strike off the register for being gay, as a result of homophobic laws in the 1980s.

It is likely that the GMC will continue to behave as if their hands are tied and that they have no choice because the “law is the law”.
But paragraph 70 of the sanctions guidance suggests they can choose to take NO action in exceptional circumstances.

Tell them that their guidelines don’t take into account nonviolent direct action (NVDA) in the pursuit of patient safety & that they should be revised so custodial sentences from NVDA do not trigger a fitness to practice tribunal.
