today for Election Heroes Day I want to do a reminder of the options at @ocboe regarding mail ballots. We process all applications the same day they come in and send to our vendor for mailing. However if the issuance is over 7 days old you may want to use the following options:

6.) If you have a ballot and have not returned it, instead of the US mail you can drop it off at any EV site or the BOE during hours of operations.

7.) You can track your ballot issuance and receipt at onvote.net Don't leave it to chance, make a plan to vote today

“They’re using the reputation of the board as a government entity as a trusted source to open up the outer piece of mail to deliver partisan messages,” Czarny said. “The Board of Elections will never send out partisan mail promoting a candidate.” syracuse.com/news/2026/10/sn…

Today starts our long march. Many election officials in New York, including myself, will start a run of 19 consecutive days where we will work as Early Voting & the post election activities combine for a marathon work schedule. Honor their service by making a plan to vote today.

Does the burden shift? I think this is the interesting thing in the DOJ's lawsuit against California over voter rolls. Everyone who is registered to vote in California provided the proof of citizenship that is required under CA law and federal law: They checked the box saying they're a U.S. citizen. And they signed a statement under penalty of law. The federal government now says: we have strong suspicions that these 20,000 people are NOT citizens. But we don't have conclusive proof. So the question is: - Does the burden shift to the voter to provide MORE evidence of citizenship than is required by law in order to stay a valid voter? Or - Does the burden rest with the government to conclusively prove not a citizen before taking any action against voter? I've always understood it to be that election officials would treat all voters the same until we had conclusive proof to do otherwise. I'd be surprised if the courts considered the government's "strong suspicion" to be enough to deny equal access to a constitutionally-protected right.

🚨BREAKING: DOJ’s demand that California investigate and block ballots from 20,000 people it alleges could be noncitizens may violate a court order barring the department from unilaterally attempting to shape state voter rolls and keep voters from the ballot. democracydocket.com/news-ale…

Just a reminder that a list like this got sent to Nevada, too. When Nevada investigated, it found that every single person on the list was actually a citizen. It's pretty obvious why California wants more information on how this matching was done. nytimes.com/2026/09/24/us/po…
Knowingly sending ballots to noncitizens is wrong So naturally, California has been planning to do it anyway

This a real escalation by the federal government. I've mostly said "Calm, calm. It's going to be OK" with respect to federal involvement in election administration. This lawsuit -- in October, in the middle of early voting -- that asks election officials to disqualify certain voters based on suspect databases, not conclusive evidence, which definitely could have been alleged BEFORE early voting began... This does represent an escalation. Shucks.
🚨BREAKING: The DOJ sued California for sending mail ballots to 20k people the Trump administration claims are likely noncitizens. The lawsuit comes after the DOJ threatened legal action if the state did not set aside cast ballots of those flagged until their citizenship status is confirmed.
