I appreciate that the Trump administration is earnestly trying to investigate H-1B fraud but the more research I do, the more dms I get, it just becomes painfully obvious that we are trying to empty the ocean with a shovel. I have literally thousands and thousands of tips that I've either already sent in or have on my list to send in. And I have BARELY scratched the surface of H-1B fraud. I haven't even started on F1 fraud, OPT fraud, O-1 fraud, it just goes on and on and on. The amount of fraud is in the millions and thousands more come in every day from every visa under the sun. There are 1.4 billion indians in india. Hundreds of millions of them want to come to America. They will do whatever it takes to scam the system to escape india and the system is so poorly set up that they will be allowed to do it. We just can't win this way. We need help. We need to turn off the fraud spigot and the only way to do that is if we totally ban all immigration from india indefinitely. It pains me to say this and I don't want to blackpill but the numbers are just too great for us to handle, anything other than a total ban on all indian immigration is just rearranging deck chairs on the Titanic.

The private sector is private. It is not sovereign. The 13th Amendment abolished slavery. The Tariff Act of 1930 prohibited the import of goods produced with forced labor. The Immigration Reform and Control Act of 1986 prohibited employers from knowingly hiring workers who are not authorized to work in the U.S. labor market. And so on and so forth. The entire history of labor, employment, and immigration law in the United States consists of government deciding that certain private labor arrangements are unlawful. And to the extent we permit imports, we necessarily accept goods produced under labor and employment laws established by foreign governments.

I know that everyone I work with are on visas... H-1B, TN, F1, 0-1A, just on my team, not a single person I work with was born in this country. It's honestly ridiculous, and then competent American engineers I know can't get a job here because "the interviewer" (on a visa) had doubts.

Sara Gonzales just interviewed a former H-1B worker who makes extraordinary allegations about his experience with multiple consulting companies, including Great America Technologies. He says he originally came to America sponsored by a consulting firm. He says he borrowed $6,000-$7,000 to cover immigration-related costs he was required to pay, including USCIS and attorney fees. Then in January 2024, his H-1B sponsorship was transferred to Great America Technologies after promises of projects and timely pay. According to his account, things got even worse. He says he went as long as SIX MONTHS without being paid. And he says the company ultimately owed him: MORE THAN $100,000 IN UNPAID WAGES. Here’s the part Washington absolutely needs to pay attention to: He says he isn’t alone. He describes a third-party consulting model where workers can pay thousands to get here, get placed with end clients, and then become dependent on the sponsoring company for both their paycheck and their immigration status. He says many other H-1B workers are caught in similar situations. This is why focusing the $100,000 fee only on H-1Bs entering from overseas leaves a massive blind spot. A transfer doesn’t magically make the employer legitimate. If an employer wants to take over sponsorship of an H-1B worker already in America, why shouldn’t that employer face the same scrutiny? And this goes beyond fees. Every H-1B employer should be subject to meaningful audits. Is the job real? Is the worker actually being paid the required wage? Who is paying the immigration costs? Is the worker sitting unpaid on the bench? Does the employer actually operate where it claims to operate? And we need a serious conversation about whether third-party consulting companies should be allowed to sponsor H-1B workers at all. The worker in this interview says his dependence on the system left him deeply vulnerable. Protecting American workers and protecting foreign workers from exploitation are not competing goals. 90% of my coworkers are Indians on H-1B, H-4 EAD, and OPT contractors and full timers. Manual testers, BAs, Scrum masters, POs. This company is packed with Indians from the CTO down to the junior consultants. The code they write and the testing they do is sloppy garbage. I’m sick of this invasion. American citizens are getting shoved out of our own jobs.
