🚨 THIS COULD COMPLETELY RESET EMPLOYMENT-BASED IMMIGRATION.
Sen. Tommy Tuberville has introduced the Americans First Immigration Act, which would replace the existing EB-1, EB-2 and EB-3 green card system with a points-based system.
But this may be the biggest part:
Under the legislative text, existing employment-based petitions still PENDING when the law takes effect could no longer be adjudicated or approved.
Related green card applications would be:
“rejected, denied, or invalidated.”
Already-approved petitions get only a limited transition under the old system.
And going forward, employers would have to:
• Recruit American workers first
• Hire an equally or better qualified American who applies
• Document the recruitment process
• Explain why U.S. applicants were rejected
• Avoid layoffs in equivalent jobs beginning 90 days before filing
• Meet significant wage thresholds
This isn’t a tweak to employment-based immigration.
It’s a proposed reset of the system.
