例のカリフォルニア州の年齢確認法AB1043であるが、それを修正するAB1856が州の下院と上院を通過したようだ。後は知事の署名ぐらいだろう。で、オープンソース関係については、問題はほぼ解消されたのではないかと評価できるかと思う。 AB1856での最大の修正点は、オープンソースのOSが明示的に規制対象から外されたことである。受領者に対してソフトウェアの複製、再頒布、改変を認めるライセンスでOSを頒布する者は条文における「Operating system provider」の対象に含まれないとされ、これによって典型的なLinux distroも対象外となる。コミュニティや頒布者が年齢シグナル機能を実装する義務を負うという当初における問題は消えたのだろう。 また、単体の実行アプリとして提供されないソフトウェア部品が条文での「Application」から除外され、「Developer」の定義も狭められた。ライブラリ、フレームワーク、パッケージ等までも一律に規制対象へ巻き込まれる懸念も後退している。下院通過時にしれっと追加されていたブラウザやWebサイト運営者にまで年齢シグナル制度を拡張する条文も上院側で削除されたようだ。そりゃ、あれはさすがに通らないわな。 ただ、オープンソースのアプリケーション除外に関しては明示的ではないし、「Covered application store」という定義が依然として広いので、aptやFlathub、あるいは他のパッケージリポジトリのサービスあたりの扱いがまだ明確ではない。このあたりはまだ気にしている。 とは言え、オープンソース界隈で懸念された問題については割と正面から修正され、反対の声を挙げていたEFFとOSI的には成功とは言えるかと思う。 なお、おそらく今回の修正は他州の年齢確認法にも影響していくと思うが、「複製、再頒布、改変を認めるライセンス」という表現は割と使われそうな気がしている。 leginfo.legislature.ca.gov/f…

OpenSourceの商標的な観点からのアプローチによる誤用の是非のような話は、日本では四半世紀経ってもまだそんなこと言ってるのかと言われそうな話題の一つだと自分は認識している。OSIが法的拘束力のある定義を伴うマークとして登録し、それを法的にコントロールしようとしたのは1998年であるが、ぶっちゃけその後四半世紀以上を経った現在においてはOpen Sourceという語は社会的・技術的・制度的に十分確立しており、各国政府の法令や国際機関の文書でも利用・改変・再頒布という中核的概念を備えた理解が事実上一般化している。 さらに米国であれば、商標権の有無とは別にLanham Actの虚偽広告やFTC Act §5の欺瞞という観点もあり、他国にも虚偽・誤認表示を規制する類似の制度がある。 よって、現在は、OSIが「Open Source」という語を商標によって中央集権的に統制しなくても、Open Source Definitionを中心として形成された社会規範が政府・企業・法制度にまで浸透しているわけであり、商標によって語義を統制しなければOpen Sourceという概念を守れない、という1998年的な問題設定をそのまま現代に持ち込む必要はもはやないし、自分の周辺では誰も気に留めてもいない。例えば、5月のG7デジタルでOSIがオープンソースAIの各国認識の共通化を支援したように、そういった浸透の方が重要なのである。
