Thomas and Alito would have let new voting barriers take effect immediately, while Americans were already casting ballots. Kavanaugh did not save democracy: he delayed the rule because there was no time to impose it this cycle, while leaving the door open for 2028. That is the tell. When Democratic presidents act, this Court invokes “major questions,” demands explicit congressional authority, and lectures the country about limits on executive power. When a Republican administration moves to burden mail voting, those limits suddenly become optional. This is not judicial restraint.
