Od začátku ruské agrese proti Ukrajině zastupuju pro bono české občany, kteří bojují v řadách ukrajinské armády a po návratu jsou v Česku vyšetřováni policií pro přečin služby v cizích ozbrojených silách. Dosud jsem takto ubránil 8 českých občanů (jeden bohužel v bojích zemřel). Včera bylo zastaveno trestní stíhání posledního z těch, které ještě zastupuju. Rozhodnutí pana státního zástupce mě potěšilo i samotným textem, kdy alespoň o jeho část se chci se svolením klienta podělit s Vámi. Státní zástupce rozhodl, že služba v Ukrajinské armádě není trestným činem a napsal mimo jiné toto. „Důležitou roli při zvažování použití principu ultima ratio pak hraje také celkový kontext. Obviněný jako občan ČR nevstoupil do armády nějakého vzdáleného státu, ale do armády země vzdálené pouhých několik hodin jízdy automobilem či autobusem. Jedná se o zemi, která byla brutálně napadena mnohem větší a vojensky silnější sousední zemí, která podobný postup využila již v minulosti (okupace části území Gruzie v roce 2008, ale pochopitelně zejména vojenské akce od roku 2014 prováděné na mezinárodně uznávaném území Ukrajiny, tj. okupace Krymu a ustavení tzv. lidových republik v Doněcké a Luhanské oblasti). For anyone wondering what's going on in the "news" about a looming Russian attack, landgrab, drone strike etc. Please remember this. Scaremongering is a Kremlin psy-op. The real attack is not on -- infrastructure -- industry -- individuals or any other physical target. It's on our decision-making. Kremlin is trying to spread FUD (Fear Uncertainty Doubt).
