@Fortnite, did here.
Lets start, no matter how much permission

@TeraCreators to recreate their game in Fortnite, they break lots of copyright here and you cant talk your way out of this.

❌Terms Broken in the Roblox Terms of Use.
@MisfitsGG breaks the Roblox Terms of Use Section 2.a/2.a.ii "Studio License" [Image 1], all assets built inside it (including the fundamental stud texture and the standard UI structures [Image 2]) are strictly leased to the creator. The license of using those textures is explicitly limited to the sole purpose of creating User-Created Content on the Services.
Passing it along to third party to upload it on Fortnite completely breaches this platform exclusivity.
The licese granted to a Roblox developer is legally defined as non-sublicensable and non-transferable.
The Developer cannot legally "give permission" to a Fortnite creator because they do not own the rights to sub-license Roblox core engine assets or avatar aesthetics [Image 3].
❌Terms Broken in the Fortnite Developer Rules, Epic Games Terms of Service and Fortnite Island Creator Program Terms
Section 1.6/1.7 [Image 4 and 5] in the Fortnite Developer Rules "Be Original". This rule explicitly dictates that creators must not create, upload or publish content that infringes upon the copyright, trademarks or trade dress of others.
Epic clearly states that publishers must either completely own the intellectual property or have an official corporate license from the rightful IP owner.

@Fortnite promotes the Island on the platform
x.com, loses the DMCA Protection of named Section 15.
The moment Epic's editorial team actively selects, reviews and promotes the 1:1 Roblox clone (with said used copyrighted assets stated in the Roblox Terms of Use) an lawyer can argue that Epic had "vicarious liability". Because Epic Games directly profits from the traffic they actively drove to a stolen game, they lose their passive immunity and CAN BE sued alongside the Creator.
Epic Games violates its own Fortnite Developer Rules. Section 1.6 in the Fortnite Developer Rules state "Be Original" [Image 4] and their intellectual property filters. Pointing out that Epic Games is actively promoting a copyright breach.
At the end, the contract states that the uploader
@TeraCreators protects Epic Games from claims arising out or their (Epic Games/Fortnite) content [Image 6]. IF Roblox would sue Epic Games because Epic Games promoted the map to millions of players, Epic will use Section 15 to pass the legal bill and damages straight to
@TeraCreators.

@MisfitsGG has the authority to let someone copy their concept or gameplay rules, but they have zero legal standing to hand over Roblox underlying copyrighted materials [Image 2 and 3].
