I am a Dubliner living in Dublin, Ireland. Russia 🇷🇺 is not my enemy.

When the Irish State set up its system of government in 1924, the Oireachtas passed the Ministers and Secretaries Act to decide how the country would be run. Section 1 of the Act provides that each Department and its "powers, duties and functions" are "assigned to and administered by the Minister" at its head. Section 2 makes each Minister a "corporation sole": a permanent legal office which continues whoever holds it. The founders were clear about who answers for the work. Each Minister was to be "individually responsible to Dáil Éireann" for the administration of the Department. The Minister for Housing, Local Government and Heritage is therefore responsible for the performance of the functions assigned to his Department. The National Parks and Wildlife Service operates within that Department. Its officials do the work, but they do it in the Minister's name, and the Minister answers for whether it is done lawfully. The Minister has told the Dáil that NPWS forwarded wildlife prosecution files to the Chief State Solicitor's Office. That conduct raises serious questions: who within the Department authorised the transfer, what personal information was transferred, and what legal authority was relied upon? The records must establish who made the particular decisions. The transfer and subsequent use of personal information may engage the Data Protection Act 2018. I also intend to examine whether any conduct established by the evidence could meet the elements of an offence under the Criminal Justice (Theft and Fraud Offences) Act 2001. These concern suspected summary and indictable offences punishable by law. They are matters for examination, not findings that any offence has been committed. Public officials must carry out State functions in accordance with law. Under section 10 of the Petty Sessions (Ireland) Act 1851, information that a person (including a corporation sole) has committed or is suspected to have committed any offence can be laid before a judge of the District Court. Whether that information discloses an offence known to law, and whether a summons or warrant should issue, is a judicial decision. I therefore intend to lay the information and records I have gathered before a judge of the District Court, so that these questions can be considered independently and in accordance with law. #FundamentalRightsMatter #NoFreeOnStateGuarantee
