The restriction operates precisely during a period when reporting may be especially consequential — after the criminal process has began but before a plea has been entered. Yet the pleading stage can be delayed considerably, and some matters never reach plea at all.
CFE intervened in the case of Caroline Peters, who challenged the constitutionality of section 154(2)(b) of the Criminal Procedure Act, which prohibits, before plea, publication of "any information relating to the charge" in sexual-offence proceedings.
That has proved very true in the Cornell Seven case. It has required the victim’s courage to speak out and institute a civil case against the University and the seven alleged perpetrators.
Often, because survivors speak. Because journalists investigate. Because evidence can be reported. And because institutions can consequently be subjected to public scrutiny.
Still, the Cornell Seven case raises a question that is worth asking ourselves in South Africa: how do we come to know about sexual violence — particularly where institutions may have failed?
