Think about LEGO 🧱 You can be a fan who buys a set and builds it 🏗️ Or you can design something yourself, share it with the community, and potentially see your idea become an official LEGO set 💡 Same IP... Completely different level of participation. And that gap is where things get interesting. Another interesting case when AI stepped into the game and changed the meaning of “use my image” phrase for creators. When a contract says a brand can “alter” or “transform” your content, you usually think about cropping, retouching or changing the colours. But in the AI era the brand thinks: generate a completely new image of you with AI tools. That’s exactly what happened in the ongoing dispute between creator Francheska Pujols and Rainbow Shops. ✦ The interesting thing: In July, the court refused to stop Rainbow Shops from using the disputed AI-generated images while the case is still ongoing. And it’s not just one case, as you go through my X page, you’ll find some other examples I recently came across. So, Bloomberg Law found similar AI clauses in creator contracts, including cases where creators could give brands very broad, sometimes even indefinite, rights to use their content with generative AI. One creator reportedly walked away from a deal rather than give up unrestricted rights to her likeness. Another said an AI-altered ad changed her facial reactions and even inserted words she never said. ▸ The scary part: you can sign away more than you think without realizing it. ▸ The reason: AI is moving faster than the contracts creators are signing. Maybe it’s time for creators to have clearer, programmable rules for how their IP and likeness can actually be used?
