Esta pájarraca, Ruth Galán, representante del sindicato de inquilinas, ha dicho en directo hoy, 2 de octubre, que llevan dos semanas negociando con los grandes sindicatos para plantear una huelga general. DOS SEMANAS. Ergo, la performance estaba completamente planificada.

El lío jurídico que han creado con los decretos de vivienda es bastante difícil de exagerar. Como explica muy bien @natalia_velilla, un mismo contrato de alquiler puede quedar sometido a reglas distintas simplemente en función del día exacto en que venciera. Los contratos que vencieron entre el 22 de marzo y el 30 de abril podrían intentar acogerse a la prórroga forzosa de dos años del RDL 8/2026, una norma que decayó al no ser convalidada. Si el contrato vencía el 1 de octubre, aparece otro régimen: la prórroga anual de hasta tres años introducida por el RDL 26/2026 en la LAU. El problema es que esa regla duró literalmente un día. Porque desde el 2 de octubre entró en vigor el RDL 27/2026, que sustituyó ese sistema por prórrogas de cinco años, o siete si el propietario era una persona jurídica. Y aquí aparece además otro ingrediente: el RDL 27/2026 se aplica a efectos futuros de contratos que ya estaban vigentes, lo que jurídicamente se conoce como retroactividad impropia. Resultado: contratos que son prácticamente idénticos pero que acaban bajo regímenes diferentes dependiendo de si vencían el 30 de septiembre, el 1 de octubre, el 2 de octubre o unos días después. Y como estas normas decaen después en el Congreso, queda por resolver qué ocurre con los derechos que pudieron nacer durante sus breves periodos de vigencia. Esto significa que propietarios e inquilinos no saben con certeza cuánto dura el contrato, qué prórroga pueden exigir y qué norma debe aplicarse. Y, previsiblemente, una parte del problema terminará resolviéndose en los tribunales.
