Cleriston Pereira da Cunha, who died in prison before he was ever tried—80 days after prosecutors supported his provisional release, with that recommendation still awaiting a ruling from Moraes. His death cannot become a footnote. The new Brazilian Senate must investigate whether defendants were punished according to evidence of their individual conduct, whether sentences were proportionate, and whether detention decisions respected due process and protected human life. In my view, there are compelling grounds to investigate judicial abuse and political persecution. Impeachment is the constitutional mechanism for holding a Supreme Court justice accountable for misconduct. Where evidence establishes other violations, the appropriate legal consequences must also follow. Responsibility is personal and attaches to those who exercise power, sign orders and make decisions affecting human lives. Official position cannot place those decisions beyond scrutiny. “Defending democracy” cannot be a blanket justification for violating constitutional rights. Moraes is entitled to due process. So was every person whose liberty he controlled. The law must protect both and hold both accountable.
