Les investigations :
à la suite de 27 plaintes dénonçant la non-prise en compte du refus des cookies et les obstacles rencontrés pour retirer le consentement au dépôt de cookies, la CNIL a effectué plusieurs contrôles en ligne sur le site web « Yahoo.com » et sur la messagerie électronique « Yahoo! Mail ».
La CNIL a constaté plusieurs manquements à l’article 82 de la loi Informatique et Libertés.
Les manquements :
- Des cookies déposés sans accord de l’internaute
- Absence d’alternative proposée aux utilisateurs souhaitant retirer leur consentement au dépôt de cookies. La seule possibilité offerte à l’utilisateur était de renoncer à l’usage de sa messagerie électronique.
La décision :
La CNIL a prononcé à l’encontre de la société YAHOO EMEA LIMITED une sanction de 10 millions d’euros rendue publique.

The investigations
NS CARDS FRANCE is a company that publishes the neosurf.com website and the "Neosurf" mobile application that allows online payments to be made after registering for the service.
At the end of 2021, the CNIL carried out two inspections of the company.
The CNIL found three breaches of the GDPR and a breach of the French Data Protection Act.
The breaches
- Retention of user account data for an indefinite period.
- An incomplete and obsolete privacy policy provided in English, whereas the target audience is mainly French-speaking.
- Weak passwords stored unencrypted in the database, together with their e-mail address and user ID.
- Failure to comply with obligations relating to the use of cookies and trackers.
The decision
The CNIL imposed two fines against NS CARDS FRANCE:
New important follow-up: the ICO has written to "many of the UK's most visited websites" about cookies, giving them 30 days to respond. "It should be as easy to “Reject All” cookies as it is to “Accept All”," the regulator said today.
