That question has now reached the Supreme Court. On 22 September, while hearing a challenge to the Delhi SIR, the Court questioned whether notices appeared to have been issued “almost mechanically” and asked the ECI to clarify the meaning of “logical discrepancy”. The Court also sought clearer guidance on what documents could resolve particular discrepancies and directed that responses should be possible through WhatsApp or email without insisting on physical appearance. The legal safeguards recognised by the Supreme Court require notice, an opportunity to be heard, a reasoned decision and an appeal. Those safeguards cannot operate meaningfully if the person receiving a notice does not know what rule triggered it, what data was relied upon or what evidence would address the alleged discrepancy. SIR is ultimately about electoral rights, but it is also about the software through which those rights are administered. The ECI should publish the systems, rules, audit records and operational protocols governing this process. (10/10)

We tested one app with over 10 million downloads. ₹29 bought 15 search credits, or about ₹1.93 per lookup. Using only a registration number, and with no OTP, login or proof of relationship to the owner, it returned the owner's name, father's name, present and permanent addresses, financier, insurance policy number, chassis and engine numbers and PUC certificate number. We searched only a vehicle belonging to an IFF staff member who consented to the test. (2/10)
