Yup. There is no invasion therefore no emergency. We are also not at war with any of the counties that the people we are deporting hail from. The alien enemies act was meant to be a war power not a means to enforce immigration policy which is supposed to be the realm of congress.

An extraordinarily sad & deleterious sign of the times that we have to cite which president appointed which judge. That's definitely not a criticism of the journalists - I understand why they do it; its more of an indictment of the poison Trump has injected into our politics.
