Replying to @ajitanjum
The two Election Commissioners, Sukhbir Singh Sandhu and Vivek Joshi, appear to have raised serious legal and administrative objections regarding Form 6, the centralisation of the ECINet software and other matters reported by @RitikaChopra__ in @IndianExpress. I have myself written several times in the past about some of these issues, which have serious implications for the integrity of electoral rolls. I reiterate that some impetuous & indefensible actions of #GyaneshGupta Chief Election Commissioner @ECISVEEP have gone beyond the realm of being merely controversial. These raise serious questions about due process, institutional checks and, most importantly, electoral integrity. At the same time, I find it difficult to understand why the two other Election Commissioners, having recorded their concerns through file notes and letters to the Cabinet Secretary, did not seek an urgent meeting of the full Commission to deliberate and decide these issues collectively and by 2 to 1 vote, if the CEC was pushing decisions, as has been reported. Take for example insertion of SIR line in the web version of Form 6 though the PDF form remains unaltered. IT systems or fields in Portal can't go beyond what the law and Rules enunciate. CEC's powers to conduct a revision don't empower him to disregard law propounded by the Parliament and Rules issued thereunder. I shall write in more detail a little later. But it should suffice to say that its latest version of Form 6 was notified under Rule 13(1) and 26 of the Registration of Electors Rules, 1960 based on amendment dated 01.08.2022 in Section 23 of the RP Act, 1950. How was the CEC allowed by the two other ECs to bulldoze that change? Was it done to undermine Aadhaar and pander to fad for SIR (despite the Supreme Court wanting it to be the 12th document)? Anybody, who would have gone through the Electoral Registration Manual and Aadhaar Act, would know that Aadhaar is still a proof of residence and proof of age as per ECI's own Manual on Electoral Rolls, 2023? Even the Aadhaar Act only prohibits use of Aadhaar as proof of citizenship and domicile. It is particularly disappointing, given his association with our common alma mater @IITKanpur and the @IASassociation, if the values of objectivity, neutrality and intrepidity couldn't be imbibed by him. Constitutional bodies can be respected only if their officers stick their neck out in the matters having long term ramifications for the nation as a whole. More on this shortly.
