I'm writing on this now, but the fascinating point of the Third Country Removal decision from the First Circuit is that all the issues now relied upon to grant the injunction were all raised by Justice Sotomayor in her 20 page dissent, joined by only Justices Kagan and Jackson.
That means six Justices opted to let the removals to third countries continue in spite of all the arguments which are now back again in the form of a permanent injunction.
If six Justices were not supportive of the District Judge's views before, why does the First Circuit think there is any more support now?
Pending before the U.S. Supreme Court are two cases with preliminary orders that it stayed before the district court entered a permanent injunction that bypassed the stay. (1) Missouri First map; (2) third country deportations. Intrigued to see how the Supreme Court handles both!
