SIBIYA CASE:
A search warrant was only granted on 1 October 2026. He was arrested on 21 September. His legal team is arguing that this was unlawful. The warrant should’ve been in place before the search and seizure occurred.
The IO states that if that happened, the cellphones and other devices would’ve been destroyed in the meantime.
There is a fine line on what the law permits on search and seizure before a warrant is issued.
