Douglas County Corrections then gave ICE four hours to take him before release, and Nebraska State Patrol stepped in to keep him in custody. Jose Ortega-Romero, 32, allegedly drove a pickup through the light and struck a Porsche near I-680 and the Irvington exit shortly before 4 p.m. on Oct. 4. Christopher Szalkowski, the Porsche’s driver, was taken to Nebraska Medical Center with life-threatening injuries and later d*ied. Ortega-Romero faces misdemeanor motor vehicle hom*icide, disobeying a stoplight and driving without an operator’s license. His bond was set at $7,500 with 10 percent required, which he posted shortly after midnight Monday. The Douglas County Sheriff’s Office said he lacked U.S. identification and presented a photo ID from Mexico’s consulate. Sheriff Aaron Hanson contacted DHS and ICE, which issued a detainer based on his unlawful immigration status. Nebraska State Patrol took custody under a transport agreement with ICE and transferred Ortega-Romero to Sarpy County Corrections, which has an agreement to hold immigration detainees. The sheriff’s office says Sarah’s Law requires federal agencies to take custody in qualifying cases involving de*ath or serious injury, but does not require Douglas County Corrections to honor an ICE detainer.
