Making the mistress read those texts herself was a brilliant defense move.
It was probably the defense’s best opportunity to create doubt by making the jury take a hard look at her credibility and motives.
But the question isn’t whether the mistress is credible in every respect. The question is whether the evidence leaves reasonable doubt about Flynn.
I don’t think it does.

As a trial lawyer, the use of phones during jury service terrifies me.
As a mother and daughter who needs access to her phone, I hate the idea of taking jurors phones during trial but what other options do we have at this point?
More allegations are emerging about the Lindsay Clancy jurors. The spokesperson for the holdout juror says several jurors were using their phones during deliberations and researching.

BREAKING: Lindsay Clancy’s defense is asking Judge William Sullivan to investigate “Juror Doe”...the lone holdout whose vote resulted in a mistrial.
The 9/18 motion seeks his confidential questionnaire, background-check results, records concerning an alleged 2021 prosecution and abuse-prevention order, cellphone metadata from deliberation days and a limited forensic examination of the phone allegedly carried into the jury room. The defense also wants Juror Doe questioned under oath about his voir dire answers, his Sept. 3 assurances and whether he used the phone or received outside information during deliberations.
The defense is also asking the court to question Juror No. 10 about what he allegedly observed concerning Juror Doe’s cellphone use during deliberations.
The defense requests that this motion be heard in open court on Sept. 29.

Fulton County: where the court orders the Sheriff to have our client here at 9:30, we confirm transportation, an expert is here and is paid by the hour, lawyers for both sides are sitting waiting, court staff, etc —and our client still isn’t here.
Maybe Fulton County should start billing itself for the chaos it creates.
Then we wonder why we can’t have nice things in this system.
