🚨🇬🇧 UPDATE: Tommo’s charges are far more serious than expected. Police have charged him with “criminal damage, criminal damage with intent to endanger life, and conduct endangering ships, structures or individuals under section 58 of the Merchant Shipping Act 1995”. He didn't just vandalise a dinghy - police are treating it as an act that could have killed the rescuer on board. This isn’t Tommo’s first arrest this year. You have to imagine he’s on very thin ice.

🚨🇬🇧 No one is saying Danny Tommo intended to hurt anyone in his Channel escapade. At sea, that isn't the test. The test is what a competent seaman would do. He failed it four times in one afternoon. You don't crowd a rescue. Unless the coastguard asks for you, you stand off. Rescue is the most dangerous moment for an overloaded dinghy. People panic, surge to one side, and boats break up. Tommo drove a speedboat into a live rescue and picked out the dinghy with the most people on it. You don't take a knife to an inflatable with someone on it. When a tube goes soft, the boat loses its shape and its buoyancy fast. The rescuer was standing between two hulls. Go in the water there and you face a crush risk as well as the cold. That's basic seamanship. You don't leave wreckage behind. A half-sunk dinghy full of lifejackets can look like casualties to a helicopter or a passing ship. False alarms and mistaken identity cost lives in the Channel. In 2021, rescuers found the wrong boat, the search for the sinking one appears to have stopped, and at least 27 people died. These waters have already shown what happens when small boats go unseen. In 2006, three men died off the Isle of Wight when a ferry ran down their yacht. It never showed up on the ship's radar. The bridge didn't see it until it was too late. Small boats are close to invisible to big ships. Everyone who goes out there in one owes it to themselves, and to the rescuers who'd have to come for them, to act like it. And the oldest rule at sea: you help people in distress. Whoever they are, however they got there. Tommo's words on the livestream were "we're going to take the one with the most on." He wasn't going out to help. He was going out to find out where they'd land. Then he told the rescuer, "Get off the boat, you've got time." While cutting it. You don't tell a man he's got time unless you know he's in danger. He knew. He cut it anyway. Not malicious. Just dangerously ignorant, and reckless with other people's lives. On the water, that's worse.

Their UK solicitor is now making the same argument, phrased in a quieter, more 'British' way. On Al Arabiya English, Andrew Ford of Holborn Adams was asked whether Donald Trump could still help. He said the US executive would decide whether the prosecution was politically motivated. He then asked whether it rested on the evidence or on "a deeper cause." He has the mechanism right. Under the US–UK extradition treaty, extradition is barred if the US executive branch decides a request was politically motivated. That is his audience. The White House has said Trump will not intervene. Marco Rubio has said Washington has no role now, and perhaps ever. Ford's evidence of political motive was MPs saying the brothers should be extradited. The best-known example is Ed Davey at Prime Minister's Questions in 2025. He said people wanted those accused of such crimes "should stand trial in our country." That is a call for a trial. Ford did not name any MP who has called the brothers guilty. The first UK charges were authorised in January 2024, under a Conservative government. The US request was made under Labour. The Crown Prosecution Service, independent of ministers, makes charging decisions. Ford also said the evidence reached the US Justice Department a week earlier and the defence still hasn't received it. He presented this as part of a pattern that would not happen with anyone else. The claim is that Britain is bypassing a Romanian ruling that put Romania's case first. On 9 September, eight days before the announcement, a US federal judge noted that neither Romania nor the UK has asserted any such dispute. On Piers Morgan Uncensored on 17 September, Andrew Ford and Adam Rasul of Holborn Adams cited a March 2024 Bucharest Court of Appeal ruling. It approved the brothers' surrender to the UK but postponed it until the Romanian case concluded. That ruling governed surrender from Romania. The brothers' own travel log, filed in Miami, records 43 international flights between February 2025 and July 2026. In April 2026, a Bucharest court lifted their judicial control. They were arrested in Miami on 18 July. In her bail ruling, Magistrate Judge Lauren Louis said the defence was asking her to resolve "a purported dispute between two foreign nations, that neither nation has actually asserted." US prosecutors filed letters from the Romanian government supporting their opposition to bail. The order notes Romania has not sought to intervene to assert any interest contrary to the UK's. On 4 September, a DIICOT spokesperson told Reuters it was not immediately clear whether DIICOT would seek the brothers' extradition from the US. Romanian law allows trial in absentia. The defence also asked why Britain had not moved sooner. The defense made that argument in Miami too. The judge declined to treat the delay as grounds for bail, noting it sat in tension with the defence's own claim that the UK had moved too early. On air, the defence said the brothers would be extradited once Romanian proceedings conclude. The dispute is over timing. In judicial review, the first formal step is normally a pre-action letter. No claim has been reported as issued. The High Court rarely interferes with prosecutors' decisions. Andrew and Tristan Tate deny all charges in the UK and Romania.
