I am very pleased to report that the United States District Court in TX has dismissed with prejudice Blue Cross and Blue Shield of Texas' claims against Zotec Partners, as of 9/23/26.
While no official count, I believe that health plans have failed in all of their attempts (8 cases filed and dismissed) in the federal courts to bypass and re-litigate issues, e.g. claim eligibility, that Congress dictated have to be determined in the IDR process per the No Surprises Act.
Thank you to Dr. William Freudenthal (Vituity), Chair of the Emergency Dept. Practice Management Association (EDPMA), and Mr. Aron Goldfeld (Team Health), EDPMA board and executive committee, for their leadership with EDPMA's "amicus curiae" (friend of the court) brief filed in support of Zotec Partners' motion to dismiss the BCBSTX complaint.
The support of the physician, IDR and RCM community against the health plans' litigation tactics has been vital to the outstanding success achieved by the community to date.

Apparently, physician independence stops being a free-market virtue the moment an insurance company has to pay for it.
Bravo to Ed Gaines, Esq. (@EdGainesIII), for his tireless work on the No Surprises Act and independent dispute resolution. IDR has helped physicians keep their practices and fight back when payers dictate what their work is worth.
The think tanks and politicians attacking IDR have disgraced themselves.
Lecturing physicians about market discipline while defending the companies holding the checkbook takes industrial quantities of gall.
Tax-exempt hospital corporations swallow competitors. Payers squeeze the practices still standing.
Somehow, the physician challenging an underpayment becomes the threat to affordable healthcare.
If your version of competition requires the independent physician to surrender, save us the policy paper.
CMS, insurance companies, and health systems already have a marketing department….
