The U.S. Department of Justice has released a statement backing Elon Musk and X in their legal fight against the European Commission. • The United States has formally asked to intervene in support of Elon and X before the EU’s General Court in Luxembourg. • Elon and X are seeking to overturn the European Commission’s December 2025 decision, which imposed a €120 million fine over alleged Digital Services Act violations. • The DOJ says the Commission engaged in “regulatory overreach” by extending its authority to American companies that were not operating within its jurisdiction. • It argues that the EU unfairly targeted Elon personally and implicated separate American companies he owns, even though they had no connection to the digital services involved. • The DOJ also raised concerns about extraterritorial jurisdiction and the Commission looking beyond X’s corporate structure to hold its shareholders responsible. • This is the first challenge to a DSA enforcement decision to reach the EU’s General Court. • The filing was prepared with the U.S. State Department because the outcome could affect other American technology companies and U.S.-EU relations. This is bigger than Elon or X. The United States is standing up against foreign regulatory overreach and defending American innovation.
