BREAKING: An African migrant has allegedly stabbed a 51 year old woman in the neck today on a moving Route 1 tram in South Melbourne. About midday on Eastern Rd near Kings Way, the migrant allegedly lunged at her with a kitchen knife. She was travelling with her dog. Passengers yelled, the driver opened the doors, and two of them chased him as he fled. She was taken to The Alfred Hospital with severe injuries. Police arrested a 37 year old African man of no fixed address. He has still to be interviewed. No name or charges as of yet but they’re pending. Broad daylight on a moving tram. Today they released the legislation and didn’t update the number. Convenient. Chalmers’ line: “We’re delivering a fairer tax system and helping fund tax cuts for workers by better aligning the tax rate on trust income with tax rates paid by workers.” Translation: lock the structure, pay 30% minimum on distributions and capital gains, or restructure and cop the states on stamp duty. The “concession” they’re spruiking: - Existing trusts at 1 July 2028 can elect a fixed distribution regime with pre nominated beneficiaries and dodge the minimum tax without changing the legal structure. - There’s three years of rollover relief from 1 July 2027 if you do want to get out of a discretionary trust. - New definition of “fixed trusts” so some commercial structures hopefully escape. CPA Australia’s Jenny Wong: the election option is an improvement. But if you roll assets into a company you still face the stamp duty problem. The rollover only deals with income tax and CGT, not the regulatory mess or state transfer duty when the legal owner of the business changes. That’s the real fight coming, a multibillion dollar stoush with the states over stamp duty if thousands of trusts move property or businesses into companies that pay a lower rate. Franking credit refunds are in there for income hit by the minimum tax. Small mercies. This is the same government that already walked back bits of the budget package after the “death tax” scare and the widow/divorcee CGT carve outs. Now they’re offering a lock in option so they can still claim they “listened” while the original revenue target sits there untouched. Family trusts aren’t just rich lister toys. They’re how a lot of tradies, farmers and small operators run their affairs and split income with spouses and kids. Labor’s answer is a 30% floor and a tw week consultation window. Draft is out.
