I exclusively obtained the pre-litigation letter directly from Bart Edmiston Jr.’s attorney, Russell Latino.
Jeanetta Brantley now has two announced lawsuits coming her way - mine, and now one involving Bart Edmiston Jr. and his family. Bart is one of the young men who was falsely accused online of being involved in Nolan Wells’ death. His attorney, Russell Latino III, sent Brantley a 19-page Notice of Anticipated Litigation, Demand for Correction and Preservation of Evidence on October 7. The letter says Latino represents Bart and his family, and that all five members of the Edmiston family anticipate litigation against Brantley.
A huge part of the letter focuses on Brantley’s so-called “enhanced” Sea Tow call. According to the letter, Brantley took audio from WLOX’s YouTube page, removed part of the audio track, adjusted the gain and EQ, and then created a transcript telling viewers what she believed she heard. That transcript included the now-infamous words “dammit Bart” followed by “NoNo’s really dead now.” Bart’s attorney says that interpretation was false and/or misleading and helped push Bart into a murder narrative.

“dammit Bart” was NOT EVEN AUDIBLE in the earlier versions of the audio. The letter says Brantley had previously shared another version of the call on July 25. At the exact point where her later “enhancement” supposedly produced the words “dammit Bart,” Bart’s attorney says there was silence. Not muffled speech. Silence. The letter says those words also were not heard in the TMZ version or in the versions played on Crime Stories with Nancy Grace on July 27 and July 30.
The letter also goes after the way the audio was handled. It says Brantley is NOT a trained forensic audio examiner and that she was not working from the original recording. Instead, she used an audio file that had already been downloaded, compressed and processed multiple times. The letter explains that YouTube compression can remove audio information and create distortions, and that adjusting EQ and gain on an already degraded file can make those problems worse.
The letter also says forensic audio professionals are warned about giving listeners a transcript because once you tell someone what they are “supposed” to hear, it can influence what they think they hear. Brantley did exactly that by providing her interpretation alongside the audio. One expert quoted in the letter said his team saw some of the methods being used online and was “chuckling” because, in his words, “you can’t do that.”
There is another major issue. Brantley reportedly told people she had never even heard Bart’s name before she supposedly heard “dammit Bart” in the audio. The letter says that is not true. It identifies multiple posts Brantley shared before July 26 that already named Bart, including a post from July 25 that literally referred to “Bart’s boat.” In other words, according to the letter, Bart’s name was already in front of her before she created the later enhancement.
