United States of America
Last Thursday, I had the privilege of giving a keynote address at the 53rd Annual Conference on International Antitrust Law and Policy, and Antitrust Economics Workshop hosted by @FordhamLawNYC, where I emphasized the significance of federalism in antitrust enforcement. I will highlight what I shared there: we at @TheJusticeDept and @JusticeATR take seriously our obligation to be the front-line national enforcer Congress designed us to be, and we take seriously our obligation to work as partners, not rivals, with the state attorneys general who share our desire to protect competition in every market across our Great Nation. That give and take is not a weakness in our system of antitrust federalism. It is the system working as Congress intended—imperfect, occasionally contentious, but still very much worth defending. Proud of @JusticeATR’s success in obtaining relief on behalf of the American people. The Department will continue to fight for fair competition. The timing of the Court’s order reflects the tradeoffs between immediate relief and remedies obtained through years of litigation.

The court’s Tunney Act approval of the Department of Justice’s settlement recognizes that the settlement resolves competitive concerns with Hewlett Packard Enterprise’s acquisition of Juniper Networks. The Department negotiated this settlement to protect competition in enterprise-grade wireless local area network (WLAN) solutions and obtained two strong remedies: 1) the divestiture of a competitive HPE business and 2) the license of Jupiter technology to an independent competitor. storage.courtlistener.com/re…

During public comment, not a single customer objected to the settlement, showing that the marketplace agrees it is a win for competition. Thirteen Democratic state attorneys general wasted a year trying to score partisan points based on rumored disagreements. With the court’s decision holding that DOJ’s settlement is in the public interest, this politically motivated charade should finally come to an end.
