NATO's @SecGenNATO has now admitted what the law has long made clear: Europe was a co-belligerent in an illegal war. Under the General Assembly's Definition of Aggression (Res. 3314, Art. 3(f)), a state that places its territory at another state's disposal for an act of aggression against a third state commits an act of aggression itself. Under the law of neutrality, a state that lets a belligerent operate from its soil forfeits any claim to neutral status. Under Article 16 of the ILC Articles on State Responsibility, a state that knowingly aids another's wrongful act shares responsibility for it. Europe cannot plead ignorance. Its runways stayed open after Minab and Lamerd. They stayed open after Trump publicly threatened to destroy Iran's power plants, its bridges and its civilisation. Every sortie after that was cleared with full knowledge. Common Article 1 to the Geneva Conventions obliged these governments to respect and "ensure respect" for humanitarian law. They ensured the opposite. So Europe can spare us the statements of "deep concern." A state that fuels the bombers is neither a bystander nor a mediator. It is a co-belligerent, and under Article 31 it owes reparation for its share of the injury.
