as a lawyer, I have nothing to say about how these people live their lives. There is no protected category in the middle between men and women. A policy that conflates or dilutes pcs is unlawful. In my submission, it is unlawful. That is ground 1 in the petition.
in this case. Governance committees are told must be 50% men and 50% women + nb. Completely possible that would be all men. A trade union might be able to spot that but on pointing it out we are met with indignation. Now on the point of NB not rec'd under law.
The PCs need to be kept as bright line characteristics. We are in an even worse position than that we just looked at. The PC is being diluted by introducing a group that isn't recognised under the law. It is a group that is women and some men. The litmus test applies equally
Women shouldn't have to wait 10 years for an endometriosis diagnosis. Shouldn't struggle for menopause care. Shouldn't face postcode lotteries.
Scotland no longer has a dedicated Minister for Women's Health. We still need one.

Crucial point being made here in the Court of Session. Operating the EA requires the protected characteristics to be handled separately. Policies on "women and non-binary people" introduce a non-protected group (and part of another group - men) and are unworkable.
at the most basic level, if a woman claims sex discrimination, then a comparator must be found, and it would be a man. We must be very careful to keep the pcs (protected characteristic) separate from each other. The 'women and nb' category creates a group of women and some men.
