🚨 BREAKING: DHS JUST PROPOSED ELIMINATING THE 60-DAY GRACE PERIOD FOR FOREIGN WORKERS WHO LOSE THEIR JOBS. And this is MUCH broader than H-1B. The proposed rule covers: E-1 E-2 E-3 H-1B H-1B1 L-1 O-1 TN And their dependents. Under the current rule, workers in these classifications can receive up to 60 days after their employment ends to find another employer, change status, adjust status, or pursue certain other immigration options. DHS is proposing to ELIMINATE that grace period entirely. Not reduce it to 30 days. Not 15 days. ZERO. DHS says the worker would generally be required to “depart from the United States immediately” when the employment or activity underlying their status ends, unless otherwise authorized to lawfully remain. And here’s where this gets really interesting. DHS estimates 3,795 workers per year currently have a new employer petition submitted during that 60-day window. 3,765 are H-1Bs. 99.2%. DHS then says approximately 2,886 employers could lose the opportunity to file petitions for workers in this situation. And what does DHS say those employers could do instead? “offer the same jobs to equally qualified U.S. workers” DHS is explicitly putting American workers into the equation. This is only a proposed rule, not final. After the $100,000 H-1B fee: Infosys: 8,886 -> 759 (-91%) TCS: 5,955 -> 284 (-95%) HCL: 3,855 -> 387 (-90%) IBM: 2,855 -> 126 (-96%) Accenture: 1,324 -> 79 (-94%) Tech Mahindra: 1,027 -> 43 (-96%) Wipro: 985 -> 112 (-89%) And then there’s Cognizant. Cognizant had 3,752 registrations last year, but no FY2027 figure appears for it in the published table. That’s notable because 93% of Cognizant’s initial H-1B petitions were consular, meaning the prospective workers were coming from outside the United States. USCIS itself says companies with consular-heavy pipelines, specifically naming Infosys, TCS, Cognizant and HCL, saw registrations fall by the thousands. These aren’t small declines. Several are roughly 90% to 96%. And many of the biggest drops occurred at companies where the overwhelming majority of initial H-1B petitions involved workers coming from overseas. 🚨 THIS IS A BIG ONE. The DOJ just charged a former SENIOR USCIS immigration officer in an alleged multi-year corruption scheme. Federal prosecutors say that from 2019 through March 2026, he accepted money in exchange for approving and expediting immigration applications. But look at what investigators allege he bypassed: • Required interviews • Supervisory review • Jurisdictional restrictions • Background checks • Standard USCIS processing protocols DOJ says many of the applicants were allegedly NOT ELIGIBLE under federal law. The defendants allegedly collected hundreds of thousands of dollars. Investigators also uncovered thousands of WhatsApp messages and hundreds of calls with applicants whose cases they handled. Think about that. A senior official inside the agency responsible for deciding who receives immigration benefits is accused of taking money to bypass the very safeguards designed to protect the integrity of the system.
