John Swinney called for central government to help councils finance equal pay settlements from opposition in 2006, then reneged when he became Finance Secretary in 2007, leaving councils to expensively finance settlements by mortgaging assets with commercial banks, hamstringing them to this day, compounding it with austerity budgets.
The legal dispute continued after the SNP became the administration of Glasgow City Council in May 2017, culminating in January 2018, when the Court of Session refused the Council's request for permission to appeal to the Supreme Court. Following this refusal, the Council *unanimously* voted to abandon any further avenues of appeal and begin negotiations.
It was not possible for Councillors to unilaterally settle the legal dispute prior to this point because it would have defied officers' legal advice, and it would have been ruled ultra vires by the Chief Executive under Section 95 of the Local Government (Scotland) Act 1973 due to the massive financial liability it exposed the Council to. It's outrageous the way the SNP have misrepresented the history of this complex legal situation for self-serving political ends, and now the chickens are coming home to roost.
