"Schools would protect women better if women had basic legal equality, but they don’t. The U.S. Constitution does not require equal treatment of women under any laws, including laws against rape. Without equality, women on campus and in the real world – can be treated unequally under all laws. For example, Title IX appears to forbid violence against women in education, but it is enforced under very weak standards, especially compared to Title VI, which forbids violence against people from other social classes, such as race, religion, and national origin. In practice this means that if you assault a male student because he’s Irish or Jewish, it’s a more serious offense than if you rape a woman because she’s female. If schools under-enforce Title VI, they could easily be sued and lose their federal funding. There are no similar consequences when they under-enforce Title IX. Segregating out crimes against women for different and worse treatment was made legal under federal law in 2012 when both parties in Congress supported the Campus SaVE Act. It was paid for by the higher ed lobby and expressly allows schools to subject women to second-class treatment when responding to their reports of dating abuse and sexual assault.
