BBB(YQ) Hearing
10/06/26
There was to be a fuller hearing today on several matters, but the big ones have been resolved in the meantime so no arguments needed to be heard today (good!):
Erin Gray said today (smiling broadly) that she will submit a supplemental order about this later today, but that resolution has been reached for
"the whole end of this saga of the 26th Omnibus Objection."
The Plan Administrator's 26th Omnibus Objection to Claims (the hitherto-only-partially satisfied Texas tax claims) has been COMPLETELY RESOLVED (see attached docket image from Kroll). IMO this is significant! These remaining claims have stood unresolved since November 2025 (almost a year), and tax issues under 11 U.S.C. § 1129 and § 507 are important to get out of the way for case resolution. I've been personally watching and waiting for these to get resolved, so I'm very glad they're now in the rearview mirror.
The reason I was always skeptical of this unresolved Objection was because of the way it stemmed from a scheduling and documentation error, and apparentneglect for many months to correct it. It always seemed to me something being left to be resolved toward the end, perhaps to allow things to look less-surmountable than they actually always were. Now that it's done with, TO ME it may mean last roadblocks are suddenly being cleared for timing.
The 35th Omnibus Objection to claims (reclassified Priority claims) has ALSO been resolved since a consent order was received from Sun Life and Health Insurance Co. No unresolved objections remain, Erin Gray said she'll submit a supplemental on this too today. These Priority claims needed to be reclassified for correct order among other claims based on the Absolute Priority Rule. Again this was a necessary step for this case on the road to resolution. Individual claim resolutions can be ongoing for years, but proper classification according to APR and pro rata class calculations need to be settled in order for Waterfall/disbursements to occur. Also, this process narrows down unknowns for the Acquirer as unknown/less-known obligations to certain classes get sorted into more-known/more-certain possible allocations for distribution.
The only adjourned matter for today was the 34th Omnibus Objection (reclassified Admin Claims, docket 4758). It's just a single claim remaining from Salesforce, Inc. and it's up for hearing on October 20th.
