Unlike Massachusetts, Illinois requires a defendant to prove insanity by “clear and convincing evidence.” The burden is not on the State.
This is a high bar to clear for copycat killer (and apparent Lindsay Clancy fan) Corie Walsh.
Corie Walsh's defense will argue that the Illinois mother was psychotic and that the charges do not amount to first-degree murder after she was accused of killing her 2-year-old son.
"She was psychotic. And this is not a first-degree murder," Andrea Lyon told reporters.
Lyon, one of Casey Anthony's former attorneys, also rejected any connection between her client’s interest in the Lindsay Clancy case and the alleged killing.
"They are not correlated at all. It’s just accidental," Lyon said, calling speculation that Walsh’s actions were a copycat crime "baseless and cruel."
