📢FACDL-Miami wants to submit an amicus brief in support of Rashaun Jones' pending petition for writ of prohibition related to the disqualification of Judge Cristina Miranda. (FACDL = Florida Association of Criminal Defense Attorneys) From page 3 - FACDL-Miami submits that the transcripts reveal that: 1) the trial judge in this case immediately treated the defense investigating potentially exculpatory evidence as facially suspicious; 2) the trial judge invoked the potential of negative professional or personal consequences to trial defense counsel without a valid basis and in a manner exceedingly likely to chill and dissuade zealous representation; 3) the trial judge treated defense counsel obtaining their own legal representation as evidence of wrongdoing, when that occurred after defense counsel were threatened with negative professional or personal consequences and after the State asked to have one of the defense lawyers sworn in for questioning; and 4) the trial court refused to allow trial defense counsel to speak on the record and take any action to represent the defendant while the lawyers were represented, saying the lawyers had to be treated like any other “criminal defendant”. #RashaunJones

"At the September 8, 2026 hearing in Case No. F21-14479, the court expressly linked trying Case No. F26-12372 to changing Mr. Jones's position in the murder case, after being told that the attorneys present did not represent him here. His attorney in this case had no notice that it would be discussed, was absent, and had authorized no substitute. The matters discussed were substantive, not administrative, as the court discussed not only the possibility of trial but the way in which this matter may assist in resolving Case No. F21-14479. The court's September 8th comments show the court has failed to presume Mr. Jones innocent and (1) believes Mr. Jones will be found guilty in this matter and (2) believes Mr. Jones should plead guilty in Case No. F21-14479, a case in which he has fervently maintained his innocence." While you are enjoying your Saturday, this man is serving a 130-year sentence for conviction secured with no DNA, with no fingerprints, with numerous constitutional violations, and with falsified evidence. Perhaps out of embarrassment or desperation coming from allowing a horrendous crime to go unsolved for years, the State of Indiana (or “gitmo”) butchered their conduct, ethics, and integrity in their case against Richard Allen. They got it wrong factually. They got it wrong procedurally. They got it wrong post-conviction. They’ll continue to get it wrong as they defend their heinous actions against Richard Allen pre-trial. They’ll continue to get it wrong as they twist themselves into a pretzel to convince you, the public, and the Court of Appeals that they did not torture a man into a false confession. They’ll continue to get it wrong until Richard Allen is released and given a new trial, and possibly even solace with his family again. One of my worst #TrueCrimeHotTakes is that #MichelleCarter got absolutely FUCKED - and I like to say that every time I see someone post about it.
Remember 17 year old Michelle Carter of Massachusetts? She was convicted of involuntary manslaughter in 2017 for sending her boyfriend text messages urging him to kill himself - “just do it babe” Conrad Roy III died by suicide from carbon monoxide poisoning in July 2014 in Fairhaven, Massachusetts. He was 18 years old. It seems he was having second thoughts because Michelle was on the phone with Conrad while committing the act, and she told him to get back inside as it filled with fumes. After a bench trial, she was sentenced to 2 1/2 years, but it was later reduced to 15 months, but only served served 11 months and 12 days before being paroled. I don’t see Alleigha Botner any different. Both encouraged the death of another person and were successful.

At a hearing the week before (Sep 3), Judge Cristina Miranda lashed out at Jones' attorney for attempting to clarify the difference between Faccidomo's representation of them, and their own representation of Mr. Jones. Attorney Peabody was kicked out of the courtroom for doing so.

Lindsey Isaacs, a 23-year-old from Palm Coast, Florida, testified about being thrown into solitary confinement for more than three days after a Flock license-plate camera wrongly tied her Dodge Durango to a deadly I-4 crash. Jail staff told her she had to stay isolated because of how serious the charges were. The cell door stayed locked for about 86 hours. She said she was terrified she would spend the rest of her life in prison for a wreck she knew she hadn’t caused. At her lowest point she didn’t want to live. She spent nearly two weeks in maximum-security jail before prosecutors dropped the charges. Flock should be sued out of existence for this.

I pulled the pleading. Usually this filing is reserved for a new case that just came down, or a very relevant case that you may find while doing other research after your brief was filed. On occasion, you use it in this way. Look for the State to "respond" to the notice with case law of its own (if it exists).
