The president of Wisconsin’s largest mosque can now be DEPORTED after Secretary of State Marco Rubio determined his presence in the United States posed serious foreign-policy concerns. Salah Sarsour has lived in America for more than three decades as a lawful permanent resident. But after the government raised national-security concerns tied in part to his decades-old Israeli military-court convictions, an immigration judge ruled that he is removable from the country. And Rubio’s determination was central to the decision. Sarsour’s attorneys say Judge Jayme Salinardi treated the secretary of state’s determination as “presumptive and sufficient evidence” supporting removal, even while rejecting separate government allegations that Sarsour lied on his green-card application and illegally registered to vote. DHS has also said Rubio had grounds to believe Sarsour “has engaged in terr*rist activity or supported a terr*rist organization.” Sarsour and his attorneys strongly dispute those allegations. They argue he is being targeted for his advocacy for Palestinians and criticism of Israel, and a federal judge previously found that he had raised a “substantial” claim that his ICE detention may have been retaliation for protected speech. But the immigration court has now ruled that the government established a legal basis to deport him. ICE arrested Sarsour in Milwaukee on March 30. He spent more than 80 days in detention before U.S. District Judge James Patrick Hanlon ordered his release in June. At the center of the government’s case are incidents dating back decades. The government cited an Israeli military-court conviction for throwing stones when Sarsour was 15 and another involving attempted weapons possession when he was 22. His attorneys say the confessions underlying those cases were coerced and dispute the government’s characterization of his conduct. Sarsour has lived legally in the United States since the early 1990s. His wife and children are U.S. citizens, and he has no criminal record in this country. But lawful permanent residency does not make someone immune from removal when the government establishes a statutory ground for deportation. The ruling does not mean Sarsour will be immediately removed. His attorneys intend to appeal and seek additional protection, including arguing that sending him back could expose him to torture. Sarsour called the decision “deeply disappointing” and vowed to keep fighting. “I will not stop standing up for what’s right and for justice in Palestine,” he said.
