Really? That would certainly be news to the late Justice Scalia.
What's “audacious” is pretending that textualists and originalists, from Justice Scalia on, didn’t see founding-era structural limits as central to constitutional interpretation.

The American Bar Association has a long history of acting more like a left-wing advocacy organization rather than a professional legal organization.

Justice Clarence Thomas has been a steadfast originalist voice on the Supreme Court for decades. We are lucky to have his leadership and judicial prudence on the highest court in the land.
By any measure, Justice Clarence Thomas is one of the most consequential judges ever to serve on the Supreme Court.
He has been the leading expositor of originalism: when you interpret the Constitution, you are governed by the ordinary meaning of its words when they were adopted.
And on race, his early dissents argued that government discrimination based on race is always wrong. Decades later, those lonely dissents have become majority opinions as the Court has followed the path traced by Clarence Thomas.
