The Supreme Court needs to look under the hood in these cases and get to what is really going on--creative pleading to recharacterize the public nuisance claims as consumer protection claims.
Great explanation from @ToddZywicki on how the left uses lawfare to go after energy producers: “What we have to understand in these cases is that this is an industry. What is going on here is a concerted effort to attack the energy industry, to basically impose the views of a small number of elites who don't care about energy prices on the rest of us, not just in this country, but in the entire world. And so the logic of these cases is the process is the punishment: Just constant litigation, try every theory that they can possibly try... It's like those tobacco cases, which is all they need to do is win one case. But they don't need to win the cases, just bring the cases and impose tens of millions of dollars on litigation fees, just keeping the litigation going forever.” @CivitasInst

Boulder and the key issues at the heart of the case: “It really reflects the basic narrative of the climate movement, which is that greenhouse gases have been accumulating in the Earth's atmosphere for a long time. They build up over a long period of time, and that they are resulting in climate change… What are they trying to regulate here? They are not focusing on activity in Colorado. They're not saying that the activity in Colorado is going to be the basis of liability. They are saying that these companies' worldwide production and sale of oil and gas contributed and enabled, via emissions worldwide, and that has caused the accumulation, and therefore they are responsible for the climate change, the weather that has now adversely affected Colorado. So their damages will ultimately be tailored to Colorado. But the activity that they are saying is the basis of liability are things that these companies do in Texas, they do in the Middle East, they do anywhere in the world, which is producing fossil fuel energy and selling it to people.”
