What if you’re wrong? When the headlines first broke about Lindsay Clancy, I didn't plan to watch. As much as I distrust legacy media, a headline of that magnitude makes you think - they must have definitive proof. The reality is, they didn’t and after 3 1/2 years they still don’t. They don't have proof of who did it and they don't have proof of when these horrific crimes were committed. The state chose a conclusion that night and in less than 24 hours, while Lindsay lay unconscious in a hospital bed, they charged her with a triple homicide because Patrick said it happened during the 37 minutes he was not home. They have since spent three and a half years trying to force the evidence to fit a narrative spun on night one. The media sold you a story, but the math and science completely shatter it. Patrick’s errands are meaningless until they can provide a scientifically based estimated time of death for the children. You cannot have an alibi when the state doesn't even know the times of death. Thus, his errands are just errands and do not clear him. Critics will immediately scream, “But she confessed!” No, she didn't. Legally, she entered a plea of Not Guilty. The reality is her track seems predetermined which should terrify everyone. For reasons we don’t understand, her defense attorney chose an insanity path after she was entirely isolated from her family for two weeks. Think about the math here: a woman with no prior psychiatric history goes to a doctor for postpartum anxiety, is placed on thirteen different drugs in four months, and is suddenly labeled insane. Any cognitive break would be an acute, chemically induced toxicity from that pharmaceutical conveyor belt. It would not be an inherent defect. By rushing onto an insanity track before the state's forensics were even completed, the defense conceded the physical acts from the beginning. It was a legal strategy that allowed the DA to bypass critical pieces of physical evidence. Lindsay never took the stand to state she committed those acts. Under any standard triple homicide protocol, this investigation should still be wide open. Both parents are still suspects. Shame on the DA and shame on the media for lying to the public for 3 1/2 years. The public accepted your headlines. They never imagined you would completely manipulate the facts and manufacture something this horrific. If you watch this upcoming 60 Minutes interview and accept an emotional performance as a substitute for real forensic answers, you are allowing yourself to continue to be manipulated. When we allow emotional headlines to manufacture a reality without actual physical data, we are permitting a broken system to shield the truth and potentially hold the wrong person responsible. We have to go back to day one, look at the actual handling of this investigation, and demand the truth. Anything less is a betrayal to the Clancy children and a betrayal to yourself.

I have serious concerns about crowdfunding jurors, but I am especially opposed to crowdfunding a juror based on the position he took in deliberations. Turning jury service, and specifically a particular vote, into something financially rewarding is abhorrent to me and frankly goes against everything the judiciary is supposed to stand for. I know public confidence in that ideal is already badly strained, but this makes it worse. The largest of these fundraisers is framed around his role as the holdout, and the total climbed substantially after he went public with his defense of his vote. The moment that money becomes a reward for a particular vote, you create an incentive that has no place in a jury room, and every juror in the next high-profile trial will know it. Counsel's handling has not helped. In roughly a day he went from calling the existing fundraisers "100% FAKE," to clarifying that unauthorized "does not in any way mean unappreciated," to announcing that he will establish an "authorized, consolidated, and official fundraiser for our Heroic Holdout moving forward." This is less than two weeks out from a status hearing on whether the Commonwealth retries this case. As it stands, we essentially have no framework for what happens when strangers send a discharged juror six figures immediately after trial because of the position he is publicly credited with taking. This has never been addressed previously by our laws, because it never had to be. I would argue that this seems like a great time to do so.
