Subjecting people to collective punishment, restricting their freedom of movement, and denying someone a job or withholding their appointment simply because another member of their family is part of an armed group are not only violations of human rights, but also contrary to constitutional and Islamic principles.
Article 4 of the Constitution of Pakistan gives every citizen the right to be treated in accordance with law. So how can a person be punished simply because of the actions of their brother, father, son, or another relative?
Yet, Alhamdulillah, we call ourselves both democratic and Islamic, while all of this continues. In some cases, entire families are being held accountable. Then where does the principle go that every sane adult is responsible for their own actions?
Recently, I came across a case before the Balochistan High Court in which one son allegedly had joined an armed organisation. The father had been a patriotic citizen and a former Commissioner, while the appointment notification of another son was withheld simply because his brother was allegedly associated with an armed group.
Sarfraz Bugti Sahib, Sir waly please put your hand on your heart and answer this honestly that in today’s rapidly changing world of technology and communication, do you have complete control over every decision made by your fifteen-year-old son or daughter? Then how can the burden of one adult person’s actions be placed on the entire family?
Our state speak of Islam all the time. The Qur’an is very clear that,
“No bearer of burdens will bear the burden of another.”
Please tell me ,does Islam permit collective punishment? Has the State not made a mockery of its own principles of crime and punishment by holding one person responsible for the actions of another?
Please reflect, at least once, on the direction in which we are heading, because the road back is becoming increasingly difficult to see.
