More than 1,000 January 6 defendants were charged with knowingly entering or remaining in restricted buildings or grounds under 18 U.S.C. §1752(a)(1) — a misdemeanor carrying up to a year in prison. Van Orden had been on the Capitol Grounds the day before & knew—or had substantial reason to know—the Capitol grounds he entered were off limits. Video shows Van Orden walking directly toward the barricades in the minutes before they were violently breached. He later crossed those same barricades. His group then milled outside the breached barricades for several minutes before crossing them themselves. Van Orden didn't just breach the barricade. He remained inside the restricted Capitol grounds for OVER THREE HOURS, including with a group displaying a "Rambo Trump" flag near one of the main approaches to the U.S. Capitol — conduct one could argue encouraged others to enter and join the melee. One could argue that there is a SHIT TON of evidence Van Orden knowingly broke the law on January 6. And one could further argue that Van Orden COULD have been charged had Donald Trump not shut down the ongoing DOJ January 6 prosecution effort, granted sweeping pardons to those already convicted, and ordered every pending January 6 indictment dismissed with prejudice.
