While just a staff statement/not binding, the SEC's FAQ released today is one of the most significant they have done to-date related to application of securities law (or lack thereof) to most digital assets.
Two things in particular:
1. Promote your network’s utility? Not an IC promise! Promote potential utility? Not an IC promise, so long as you aren’t promoting profit. Keep building and improving a functional network? Not “essential managerial efforts.”
Under this statement, the SEC is all but admitting that the LBRY case and many others should have never been brought and were wrongly decided by the lower courts who heard them.
2. The SEC now says announcing a buyback for a functional network does NOT constitute essential managerial efforts.
Compare that to the prior SEC, where statements about token value, supply, and issuer incentives were central to enforcement theories.
LOVE TO SEE IT! Will be working to turn these statements into binding rulemaking, but this is insanely bullish for the digital asset community and cause for celebration.

I find it baffling that it is considered backroom and shady to pay taxes to a state. Isn’t it the opposite? Was it also backroom and shady when Illinois jammed prediction market tax language into their budget with less than 30 minutes to review? Where is the commentary on that.
Legislators are the ones who decide where tax revenue is allocated, not companies! Perhaps next time a story like this is written, they learn the legislative process instead of creating false narratives about how it works.
If state legislators want to dedicate PM tax revenue to specific services, go for it!
And why is the casino industry opposed to prediction markets paying taxes and states collecting revenue? Let’s be honest about what’s really at stake - this isn’t about protecting consumers. It’s about protecting their monopolies.

Today, the @CFTC took an important step toward bringing regulated onchain markets to the United States: firms can now keep required records on a public blockchain without being required to maintain a separate offchain copy.
The CFTC also clarified that firms can invest customer funds in tokenized versions of investments that are already permitted.
That matters because a regulated firm can now use a public blockchain as its system of record, where every entry is transparent, tamper-evident, and verifiable by anyone. Those are the assurances the CFTC’s recordkeeping rules exist to provide, and public blockchains deliver them by design.
In July, HPC and @phantom asked the CFTC to provide this clarity. Today, the CFTC delivered.
Pleased to see staff update these frequently asked questions consistent with the agency’s ongoing efforts to provide regulatory clarity for the crypto industry.

Enterprises expect customer balances and payments to be private.
To date, privacy with stablecoins has been difficult and requires significant trade-offs.
Tempo Zones allow enterprises to keep stablecoin balances and payments private, control who can view / access, and seamlessly interoperate with the rest of Tempo’s mainnet liquidity.

How far we have come from the Obama admin viewing tech as a positive and strategic national imperative, to the former President himself saying that the principal application of AI, agentic use, is bad and exists only to “justify valuations.”
Amusing this took place at my alma mater @colgateuniv, where “Dreams of My Father” was our freshman year intake required reading
🚨 OBAMA ON AI: "If we are thinking about AI just in terms of how do we cure cancer or get better energy, you can do that without having agentic AI and having it just roaming free in the internet. The reason you are doing that is because you have to market a product that people will pay money for.
That’s a misalignment between what our society needs and the commercial imperatives that these companies are facing, not because necessarily they’re trying to do bad things, but because they’ve got to justify these valuations.
So, that’s one more reason why it is really important for us to have a competent government and a serious bipartisan conversation around this issue, and we have to do it fast. And I would encourage voters to pay attention to this. If somebody does not have a serious plan for how to deal with this, then they’re not meeting the moment, and you should probably look for somebody else."
