We’ve never seen anything like this before. A man was conscripted into jury duty by the government. He performed his civic duty and followed his conscience, refusing to acquit a woman who confessed to systematically executing her three children. The defense attorney immediately launched a public smear campaign against the juror. Soon several other jurors joined the campaign. Then the media. Even the defense attorney’s wife has joined. Now they’re doxxing the man, digging into his past, contacting his family, showing up at his house. All of this both to punish him for refusing to go with their program, and to pollute any future jury pool by making it clear that anyone who votes to convict Clancy will have their life destroyed. It’s truly one of the most outrageously evil things we’ve ever seen from the Left, and that’s saying something. A direct assault on the integrity of our justice system. They are burning down every boundary and standard in their path. And doing it all for the sake of a child murdering psychopath. Unfathomable.

I am the purveyor of the popular social media commentary account, “Cynical Publius.” I am working on an article regarding the extreme lack of ethical behavior by modern American legacy media outlets such as your employer, the Washington Post. The Washington Post recently published an article with your byline where the personally identifiable information (“PII”) of certain alleged service providers to the Department of War was publicly revealed. In a separate, private communication you stated that you had obtained all or some of that information via the “Pentagon system.” Since you are a private citizen who has no authorized access to such system, I can only assume that a federal employee (the “Leaker”) provided you with unauthorized access to data from such system. I was hoping you could answer a few questions regarding this matter: 1. If you solicited such information from the Leaker, did you advise the Leaker that the unauthorized release of PII is potentially a criminal misdemeanor under 5 U.S.C. § 552a? 2. What is the Leaker’s identity? If there is no Leaker, how did you gain access to the "Pentagon system"? 3. Do you have any moral qualms over the popular journalistic practice of soliciting information from a federal employee that could potentially lead to his or her imprisonment? 4. Does your employer condone the practice of journalists soliciting criminal behavior from federal employees? Is this standard practice for the Washington Post? 5. Assuming the Leaker provided you with the unauthorized PII, did you pay the Leaker any money or otherwise make promises of remuneration in exchange for the information you obtained? 6. You have been a vocal opponent of the Pentagon limiting unaccompanied Pentagon access for journalists. One of the Pentagon’s stated reasons for this policy is to prevent journalists from soliciting criminal behavior from federal employees. Do you still oppose limiting unaccompanied journalist access to the Pentagon? Dear socialist friend, Nothing is stopping you. If collective ownership works so much better, you can prove it by next Tuesday. Pool your savings with your comrades. Elect a planning committee. Run a bakery, a farm, a repair shop – shared ownership, equal pay, decisions by vote. All of it is fully legal, today, everywhere in the West. No revolution needed. And yet. You want the workers to seize the factories – but you won’t open a food truck with three people from your group chat. You demand collective housing – but you won’t sign a joint lease with people who agree with you about everything. People have tried voluntary socialism for two hundred years. The communes keep dissolving – the members simply walk out. The only socialist countries that lasted were the ones that locked the borders. That’s the whole story. Where leaving is allowed, everyone leaves. Socialism only survives where leaving is banned. The people voted – on foot. Just do it. Or admit that "collective" was always just a word for other people’s property.

A law does not magically become constitutional because it managed to survive for a hundred years. That is not how the Constitution works, and it never has been. The gun-control groups are currently having a collective nervous breakdown because the Department of Justice refused to keep propping up the NFA’s registration regime for suppressors, short-barreled rifles, and short-barreled shotguns after a federal court called it what it is: unconstitutional. Their outrage rests on one childish premise ... that age equals legitimacy. “Congress put these safeguards in place nearly a century ago,” they cry, as if the calendar itself confers constitutional blessing. It does not. The Alien and Sedition Acts were old. Japanese internment had paperwork and precedent. Plenty of ugly, rights-crushing statutes have enjoyed long shelf lives before the courts finally put them down. Longevity is not a defense. It is often just evidence that the political class got away with it for too long. The demand that DOJ had some solemn institutional duty to appeal and keep the registration scheme on life support is pure institutional superstition. The executive branch is not a museum curator for every statute that has ever been on the books. When a court correctly identifies a constitutional violation, the proper response is not to fight to preserve the violation out of habit or political convenience. The proper response is to let the infringement die. They treat the Constitution like an annoying technicality that should yield whenever a preferred restriction has simply been around long enough. That is not how a constitutional republic functions. Age is not authority. Survival is not legitimacy. And DOJ was under no obligation ... moral, legal, or institutional ... to defend a regime the courts had already declared unconstitutional just to soothe the feelings of people who prefer their rights limited by tradition rather than by the actual text of the Constitution.
