Maria Robles ended up handcuffed on the ground during the arrest of her son Roman—after a traffic stop for driving without a warrant.
Family admits the elderly woman did touch an officer—but says the response was extremely excessive.
"They said they are going to press charges against her," her daughter said.
"They were going to take her to jail because they said she assaulted an officer."
Incident occurred in Batesville, Texas—about 85 miles southwest of San Antonio.
